Copyright & DMCA policy

We respect copyright, we respond to proper notices under the Digital Millennium Copyright Act (17 U.S.C. § 512), and we terminate the accounts of repeat infringers. Customers warrant they hold rights to everything they upload; this page is the process for when someone believes that warranty was false.

Sending a takedown notice

For a notice to be valid under § 512(c)(3), it must include:

Know that § 512(f) creates liability for knowingly material misrepresentations in a notice. On receiving a valid notice we remove or disable access to the material promptly and notify the account that posted it.

Counter-notification

If your material was removed and you believe that was a mistake or misidentification, send a counter-notice to the same agent containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury of your good-faith belief the removal was error; and your name, address, phone number, and consent to the jurisdiction of the federal district court for your district (or, if outside the United States, for the Northern District of California). We forward counter-notices to the original claimant; if they do not notify us within 14 business days that they have filed a court action, we may restore the material.

Repeat infringers

An account that draws repeated valid infringement notices gets terminated. We keep the judgment call on what counts as repeated, and we exercise it in good faith.

How listing-photo rights usually work

Worth knowing before anyone sends anything: the listing photographer typically owns copyright in the photos and licenses them to the agent for marketing uses. Kit assets are derivative works built under the customer's license, and our terms require the customer to hold rights that cover that. A photographer who believes a customer exceeded their license is exactly who this process exists for.
